This is the Privacy Policy of Foxwell Digital LLC, a company registered in Wisconsin whose office is registered at 1934 W Lawn Ave, Madison, WI, 53711 (“Foxwell Digital,” “we,” “us,” or “our,”). Foxwell Digital is the sole processor and holder of the information collected through the Foxwell Digital platform located at https://www.foxwelldigital.com/(“Site”). The terms “user,” “you,” “your,” or “yourself” refer to all users of the Website. Foxwell digital also provides various digital marketing services through the Site (“Services”).

Foxwell Digital has created this Privacy Policy to demonstrate our serious, continuing commitment to the privacy of the personal information you provide when using the Site and Services.

This document discloses Foxwell Digital’s information-gathering and dissemination practices. Foxwell Digital recognizes and respects the importance of protecting your privacy and our policy is designed to assist you in understanding the information we collect, why we collect it, how we protect it, and your rights. 

THE INFORMATION WE COLLECT

Foxwell Digital collects information that you directly choose to provide while using Foxwell Digital services and information that Foxwell Digital collects indirectly from your use of the site. Any information Foxwell Digital indirectly collects is outlined in this policy. 

Foxwell Digital collects the following personally identifiable information from you: 

  • Identity data (including name, email address, phone number)

  • Profile data (including username, password, company details)

  • Payment data (including billing address and credit card information)

  • User data (including data you enter on the Site, progress data for courses in which you are enrolled on the Site) 

The Site also collects data through a tracking pixel, including IP address, Site usage, and other data to create a de-identified data profile on each user of the Site, including you.

Cookie Notice

Foxwell Digital may store certain information from a user’s web browser using “cookies.” A cookie is a piece of data stored on the user’s computer tied to information about the user and their use of the Site. Foxwell Digital may use session-ID cookies to confirm that registered users are logged in. These cookies would terminate once the user closes the web browser. Foxwell Digital may also use persistent cookies that store certain personal data already provided to Foxwell Digital to make it easier for a user to log back into the Site. A user can remove or block cookies using the settings in the user’s web browser if a user wants to disable such functions, but such action may impair the full functionality of the Site.

WHY WE COLLECT THIS INFORMATION

Foxwell Digital does not sell, rent, or trade any of your information with third parties. Foxwell Digital does share your payment data with Stripe, Foxwell Digital’s third-party payment vendor, in order to complete your payments through the Site, as well as your user data that corresponds with your use of Slack and Podia as platforms that help to facilitate the use of the Site. One of our goals is to consistently improve as a business and support our clients’ needs. To do so, Foxwell Digital gathers certain information from Site users for their future reference, to analyze trends, to keep users in the know about updates to our services, and to optimize the Site. Foxwell Digital will not conduct any other use of your information without your prior written consent.

To Improve Our Services and Products

Foxwell Digital strives to provide quality content and experience for users. Achieving this goal requires Foxwell Digital to continually assess the effectiveness and accessibility of our services and platform. How users engage with the Site is critical to our self-evaluation for improvement and development. We also maintain email lists to keep our users informed of updates to services through our Site. Your information will not be used to assess the effectiveness of any other products or services other than those of Foxwell Digital.

HOW WE MANAGE THIS INFORMATION

Storage

Aside from your information that third parties collect or possess, all information is contained on servers controlled by Foxwell Digital. All servers Foxwell Digital controls are located within the United States. Access to the data is password-protected.

Access

Only three (3) of Foxwell Digital’s agents can access the data on the servers Foxwell Digital controls. Only one (1) of Foxwell Digital’s agents has administrative privileges over the data on Foxwell Digital’s servers. 

Third Parties

Foxwell Digital interacts with third parties in two ways:

  1. Foxwell Digital uses third party platforms, including, Slack, Podia, Stripe, and Klaviyo to help facilitate the services provided on the Site.

  2. Foxwell Digital shares data through a tracking pixel so that third parties, including Google and Facebook, can develop anonymized and de-identified marketing profiles based on user data.

YOUR RIGHTS

Foxwell Digital encourages all users to know their rights regarding their privacy. If you choose or need to exercise any of the rights listed below, Foxwell Digital will honor your request to the best of our ability. You do not need to provide reasoning as to why you are making this request. We respect your choices, and it will not harm your relationship with Foxwell Digital, nor future use of our products and services if you elect to use the products and services in the future.

Request Access to Your Personal Information

At any point, you may request access to a copy of the information we hold about you and how we are processing it. There are no costs associated with requesting access to a copy of your information.

Request Changes or Corrections to Your Personal Information

If any information we hold about you is later discovered to be incorrect or requires other changes, you may request that these changes to your information be made. 

Request Erasure of Your Personal Information

You may request that we erase some or all your information that we store. We will advise you if this erasure will affect your use of Foxwell Digital services or products in any way. 

Withdraw Consent

YouUser may withdraw consent from our storage and uses of your information at any point in the future. Any uses of your data before this withdrawal of consent, however, cannot be undone. We will advise you if withdrawal of consent affects your use of Foxwell Digital services or products in any way. 

COMMUNICATION

The majority of Foxwell Digital communications are conducted via email, you have the option to unsubscribe from any email correspondence, and in doing so will no longer receive further email communications. 

UPDATES TO OUR PRIVACY POLICY

This policy is subject to change. It will be continuously assessed as Foxwell Digital develops as a company, business practices change, and to our users’ and needs. If you agree to this current version of this policy, any future changes to this policy will be communicated to you via email.

When you send us an inquiry or request regarding your information, please provide us with your name (first and last), email address, mailing address, and the year in which you used Foxwell Digital’s services. We will respond to your question or request as soon as possible.

HIVE HAUS MEMBER RELEASE AND LIMITATION OF LIABILITY AGREEMENT

This Member Release and Limitation of Liability Agreement (the "Agreement") is entered into by and between the undersigned member ("Member") and Foxwell Digital LLC, including its brand The Hive Haus and any parent, subsidiary, affiliate, successor, or related entity, together with their respective officers, directors, employees, contractors, and agents (collectively, the "Company"), effective as of the date of Member's acceptance.

1. Nature of the Community. The Hive Haus is a membership-based community that provides a forum in which UGC creators, brands, agencies, and other members may connect, communicate, and independently form business relationships ("Member Partnerships"). Member acknowledges that the Company operates solely as a facilitator of introductions and community resources. The Company is not a party to, broker of, guarantor of, or participant in any Member Partnership, and does not vet, endorse, supervise, or verify any member, brand, agency, opportunity, or representation made within the community.

2. Assumption of Risk. Member understands and agrees that any Member Partnership is entered into at Member's sole risk. Member is solely responsible for conducting due diligence on any counterparty, negotiating and documenting terms, invoicing and collecting payment, complying with applicable laws (including FTC disclosure requirements), and resolving any dispute arising from a Member Partnership.

3. Release of Claims. To the fullest extent permitted by law, Member hereby releases, waives, and forever discharges the Company from any and all claims, demands, damages, losses, liabilities, costs, and expenses of any kind, whether known or unknown, arising out of or relating to: (a) any Member Partnership, including any failed, breached, unpaid, misrepresented, or unperformed engagement; (b) the conduct, statements, content, or omissions of any member, brand, or agency; (c) any interruption, error, outage, data loss, security incident, modification, or discontinuation of the community platform or any third-party service on which it operates; and (d) Member's access to or reliance on any content, resource, or opportunity posted within the community.

4. Waiver of California Civil Code Section 1542. Member expressly waives all rights under California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Member acknowledges this waiver is a material term of this Agreement.

5. No Warranties. The community and platform are provided "as is" and "as available." The Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the quantity, quality, or outcome of opportunities or Member Partnerships.

6. Limitation of Liability. To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost opportunities, or reputational harm. In no event shall the Company's total aggregate liability arising out of or relating to this Agreement or the community exceed the membership fees paid by Member to the Company in the twelve (12) months preceding the event giving rise to the claim.

7. Indemnification. Member shall indemnify, defend, and hold harmless the Company from any claim, demand, or proceeding brought by a third party arising out of Member's participation in any Member Partnership, Member's content, or Member's breach of this Agreement.

8. Dispute Resolution. Any dispute between Member and the Company arising out of this Agreement shall be resolved by binding arbitration in [County], California, administered under the rules of [JAMS/AAA], on an individual basis only. Member waives any right to participate in a class action against the Company.

9. Governing Law. This Agreement is governed by the laws of the State of California, without regard to conflict-of-laws principles.

10. General. If any provision of this Agreement is held unenforceable, the remainder shall continue in full force. This Agreement, together with the Company's Terms of Service and Privacy Policy, constitutes the entire agreement between the parties regarding its subject matter. Nothing in this Agreement limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.

Whether you're responding to a brand, introducing yourself to an agency, collaborating with another creator, or asking a question inside the community, professionalism matters.

We encourage respectful communication, timely responses, and following through on commitments. If life happens and something changes, communicate. Your reputation is one of the most valuable assets you'll build in this industry.

We Believe in Helping One Another

No one succeeds alone. Some members are landing their very first collaboration. Others have worked with hundreds of brands. Every experience has value.

We encourage members to ask questions, share knowledge, celebrate wins, offer constructive feedback, and support one another without judgment. We believe there is room for everyone to succeed.

We Believe in Transparency

One of the greatest strengths of Hive Haus is that creators can learn from each other's experiences.

If you've had a wonderful experience with a brand, agency, or creative strategist, we'd love to hear about it. If you've experienced payment issues, unclear communication, unfair contracts, or anything that concerns you, we encourage you to share that with the Hive Haus team.

These conversations help protect the community, educate fellow creators, and allow us to advocate for you.

We Believe in Fair, Transparent Pricing

At Hive Haus, we encourage creators to charge rates that reflect the value they bring while also making it easy for brands to work with them.

One area where our philosophy may differ from others is usage rights. While many creators separate usage rights into additional fees, we've found that keeping pricing simple often creates a better experience for both creators and brands. Straightforward pricing removes friction during negotiations and allows everyone to focus on creating great content.

That doesn't mean you should undervalue yourself but it also doesn't mean simply rolling usage rights into an inflated base rate. The goal isn't to make one video cost dramatically more under a different pricing structure. It's to charge fair, competitive rates that reflect your experience, the quality of your work, and the value you provide.

There isn't one perfect pricing model that fits every creator or every brand. Our goal is simply to help creators build sustainable businesses while remaining professional, competitive, and easy to work with.

We believe the strongest creator-brand relationships are built on transparency, fairness, and mutual respect not complicated pricing structures.

We Believe in Honesty

Trust is everything. We encourage creators to accurately represent their experience, portfolio, audience, and capabilities. Likewise, we expect brands to communicate honestly about expectations, timelines, budgets, and deliverables.

What We Don't Stand For

In order to maintain a community that everyone can trust, there are a few things that simply don't align with the values of Hive Haus.

Applying on Someone Else's Behalf

Hive Haus opportunities are for Hive Haus members.

Submitting a spouse, boyfriend, girlfriend, parent, sibling, friend, or anyone else who is not an active member takes opportunities away from creators who have invested in this community. If someone wants access to Hive Haus opportunities, we'd love to welcome them as a member.

Scamming or Dishonest Business Practices

We have zero tolerance for creators who accept opportunities and fail to deliver, or brands that refuse to pay creators after agreed-upon work has been completed.

We will always investigate concerns brought to our attention and reserve the right to remove members or brands that consistently act in bad faith.

Bullying, Harassment, or Disrespect

Healthy discussions and differing opinions are welcome. Personal attacks, gossip, harassment, discrimination, or intentionally putting others down are not.

Hive Haus should be a place where members feel comfortable asking questions, sharing experiences, and learning without fear of ridicule.

Stealing Another Creator's Work

Copying another creator's portfolio, videos, scripts, photos, testimonials, or claiming someone else's work as your own damages trust throughout the industry.

Originality and authenticity will always be valued over shortcuts.

Ghosting Brands or Agencies

If you accept a collaboration, communicate.

Unexpected situations happen—we understand that. What matters is being honest and keeping everyone informed rather than disappearing.

Professional communication protects both your reputation and the reputation of Hive Haus as a whole.
